Host Property Protection Program
Program Details
RV Overnights LLC, a New Jersey limited liability company (“RV Overnights”) requires that its Hosts obtain and maintain liability insurance. Members are also required to carry insurance in accordance with law, and to keep valid proof of such insurance during their visit to a Host property. RV Overnights is supplementing its service offerings by automatically providing assistance to its Hosts in the event a Member causes damage to a Host property. This Program (the “Program”) provides for Hosts to be reimbursed the deductible (the amount the Host must pay its insurance company before receiving insurance policy proceeds) in the event its property is damaged by Members.
In the event a Member damages a Host’s property during an approved visit, recovery from loss should be sought via the insurance carried by the Host, and by the Member (as applicable). To the extent such insurance does not make the Host whole due to its insurance policy deductibles, RV Overnights will make the Host whole, in accordance with the following:
A. In the event of property damage, RV Overnights will pay the Host 1 times the amount of the actual insurance deductible paid by the Host, or up to $2,500, whichever is lower.
B. Such payment by RV Overnights is subject to the following material conditions:
1. The Host, at the time of the visit during which the damage occurred, was in good standing with RV Overnights in full compliance with the RV Overnights then current Terms of Use.
2. The Member, at the time of the visit during which damage to the Host occurred, was active and in good standing with RV Overnights in full compliance with RV Overnights then current Terms of Use.
3. The real property damage was caused during a visit booked and approved via the RV Overnights platform (website or mobile app).
4. The Host must notify RV Overnights of its claim within two (2) weeks of learning of the damage, and in any event within two (2) weeks of the end of the Member’s visit that actually caused the damage.
5. Payment to the Host under the Program is subject to RV Overnights review of any and all documentation and interviews it may reasonably request, such as (as examples) proof of insurance deductibles paid, copies of insurance company investigations, photographs of the damage, repair estimates and police reports (if any).
6. Based on its internal review of the facts and circumstances of the incident, RV Overnights shall make a determination on whether it should pay the Host under the Program, and if so, in what amount. The determination by RV Overnights shall be made in good faith, and is final, conclusive and non-reviewable. RV Overnights may also, in its sole and absolute discretion, decide to honor no more than one claim of damage per Member in any calendar year.
7. RV Overnights may, as a condition of completing payment, require the Host to: (a) represent that the above conditions have been satisfied, and (b) execute a general release of RV Overnights from liability arising out of the Member’s visit.
C. The RV Overnights Program applies only to property damage and does not apply to damage: (i) to property not owned by the Host at the time of the damage, (ii) in the nature of ordinary “wear and tear,” (iii) in the nature of death or personal injury, or (iv) in the nature of damage to animals, trees or other plants.
D. The RV Overnights Program constitutes part of the package of services that RV Overnights provides to its Hosts and is not a contract of insurance. No premium or other payment is charged for the Program. In the event of any conflict between the Program and RV Overnights Terms of Use, the Terms of Use will control. Hosts are not third-party beneficiaries of this Program.
